The Marketplace Fairness Act of 2013 (S. 336/H.R. 684), expected to be put to a vote in the Senate in the next few days, threatens to disrupt this imperative balance.
If the Marketplace Fairness Act of 2013 is passed, online retailers will be required to collect and remit sales taxes for upward of 10,000 unique tax jurisdictions across the United States. In practice, this means: a substantial increase in overhead costs associated with collection and submission of these taxes; new tax reporting requirements; increased risk for tax audits and lawsuits; and, loss of sales resulting from the imposition of these taxes, as well as the increase in retail pricing that will inevitably follow.
